• Remove any copyright, trademark, or other proprietary notices from content

Users may have the opportunity to submit content, including but not limited to comments, feedback, and forum posts (collectively, "User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

Refund Policy

Digital purchases, including game downloads, are generally non-refundable. However, we may consider refund requests in exceptional circumstances, such as technical issues that prevent the game from functioning as advertised. Refund requests must be submitted within 14 days of purchase and will be evaluated on a case-by-case basis.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. IN NO EVENT SHALL DEADSEAT STUDIOS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
• ANY CONTENT OBTAINED FROM THE SERVICES

OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to defend, indemnify, and hold harmless Deadseat Studios, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the Services.

The Services may contain links to third-party websites or services that are not owned or controlled by Deadseat Studios. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that Deadseat Studios shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach the Terms of Use.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms of Use shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms of Use shall first be attempted to be resolved through informal negotiations. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the arbitral decision may be enforced in any court.

Any legal action or proceeding relating to your access to or use of the Services shall be instituted exclusively in the federal or state courts located in the jurisdiction of our main office. You and Deadseat Studios agree to submit to the personal jurisdiction of such courts.

If any provision of these Terms of Use is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

The failure of Deadseat Studios to enforce any right or provision of these Terms of Use will not be considered a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Deadseat Studios regarding your use of the Services and supersede all prior and contemporaneous written or oral agreements between you and Deadseat Studios.
